Warranty Problem!

Hey guys,

just wanted to share my experience with the warranty.

Went in for a differential problem, they knew exactly it was the differential and they started checking it. Got called on 2 seperate full days to make different checks to approve the differential change. They told me everything is ok and they ordered the part.


They called to say the new differential has arrived and we booked the first date available. The called me at 8.00 on Monday and i arrived at 9.30-10 and they told me they are going to change the part Wednesday and i told them i'm going to bring it in on Wednesday. I didn't bring it in on Wednesday and went ahead and got a stage 1.

Called in to book the next date and they told me they have to redo the whole procedure because of a 30 day limit. I sent a emails here and there saying how i already got approved and there is now way i'm accepting this. They said ok, just bring the car and we'll fix it.

Now they want to deny the reparation as the system said it has been tuned and we are in a big conflict my side being that the part got approved to be changed,ordered and it also arrived and that me tuning it AFTER has no importance to this matter, future matters? yes. This matter? No.

Problem is it's monday and my warranty expires wednesday and the car is at them ATM.
Problem is They tried to deny the reparation but after showing a full understanding of contractual laws and the evidence being on my side that i will take them to court with this matter. Made them switch from denying to sending an email to BMW and them having the final say.

What do you guys think? Legal? moral?

Yeah, I'm aware I might have used too much logic and been less realistic. Logically and morally I am in the right IMO. Realistically.... Murphy's law.

Should have waited to do the tune after the warranty work but you know that already. Be ready to pay if you wanna play...Good luck

Warranty denial regardless, why would you, knowing that you had a differential problem, choose to tune the car before it was repaired???????

Let’s pray for the best. I think the itch to tuning could’ve waited, but now if you already got approved I can’t see a reason for them to take it back just because you tuned it since the issue was present before.

Why? Because the defect happen before tuning and they have checked the car for any warranty void, didn't find any so they went ahead and ordered the part and only after the part arriving at the dealer only i went ahead and tuned it.
They have all the evidence in writing that the car was eligible for the part change. Why can't i tune my car after all this procedures happened? That's all internal bs.
The only step left was them installing the part, all the other paperwork, verifications were done and approved.

If things only worked like they're supposed to in the real world...again,I wish you the best of luck getting BMW to fix this issue as well as any others now that they know you have a tune and it's been noted in their system

Thanks for sharing. Hopefully will help someone with their decision making knowing that stealership will try any excuse to charge more when a tune is involved.
They know your car is broken and needs fixing. BMW NA will compensate them much less with agreed upon rates vs. charging you direct because they will get more from you.

But did BMW run a diagnostic test for any kind of tune the first time it went in for the diagnoses If so, why test it again when it returned for the repair.
I think they did it just the once and that was just prior to the repair and they only have the opps word that it was only tuned between diagnosis and repair.

The first time around they said it's a pretry long diagnosis and paperwork since the part is expensive and it's a rigurous procedure. I'm certain they did. And first time was actually 2 separate days morning till closing time to complete all paperwork since they forgot to some step from the procedure.

The second time they checked, upon intalling the part it was just a general diagnosis to make sure the car is fine, as the tehnician told me on the phone.

I've had a few friends fight this battle, they lost horribly. You break the warranty before the work is done you have no legs to stand on I'm afraid. Try and negotiate the best you can and be amicable to paying half you can even get that.
