BMW Electric Coolant Pump Class-Action settlement
I received notice today regarding a class-action settlement relating to electric coolant pump failures on various BMW engines model years: 2007-2019. Apparently, if you've had a failure on an affected vehicle, you are eligible for a reimbursement of up to $1,000 for pump and thermostat failure as long as the failure happened within 7 years entry into service and 84,000 miles, and the vehicle was repaired by a BMW authorized shop or independent shop.
The letter also stated for those that have not experienced failure, warranty will continue on the affected parts for 7 years after entry to service and 84,000 miles. A claim form was attached to be sent in with proof of repairs. Given the settlement, I'm wondering why BMW doesn't just treat this as a recall and fix all of these pumps. The cat is out of the bag and I'm sure those who fry their engines due to an overheat may also have a claim against BMW for a know defective pump. |

Why BMW doesn't make electirc coolant pump & thermostat a recall...
I got the same letter yesterday and pulled the paperwork from my '11 335xi MT6 (which met its demise in 2017!). My receipt totaled $1476 for replacement of both parts, coolant and misc. shop stuff. I called 3 different BMW customer service folks and was told that I could submit my info to the bmw-rp.com site. Unfortunately all 3 reps were wrong - the only item covered under any program for that car was a foot well module. Finally I spoke to the BMW reimbursement rep in Tx. I was told that there is no BMW recall or reimbursement for the electric coolant pumps/thermostats. BMW's approach is "there's no problem so we don't have to pay for anything". I then completed the online form to participate in the class action suit. BMW has lots of lawyers, now consumers have one, too. Reminds me of a license plate I saw last year in BC : LAWYRUP!

I received the same letter yesterday. I replaced the water pump and thermostat a year and a half ago for my 2012 X3 35 when the water pump went out at 75000. Unfortunately I did the repair myself so I'm sol.

I got the letter today but haven't read the details yet. But I had it replaced before it failed and beyond 84k miles, so I am likely sol

I haven't received any letter yet. Do you guys know what engine/yr is covered? I got a 17 x28i and noticed my oil/coolant temp is very unstable (go to1/2 mark at highway speed and drop to 1/4 mark once slowed down to city speed)

your temps are fine...its only an issue if your temp goes above the 1/2 mark. And this class action only covers if you had a failure of the pump, not preventative maintenance.

The oil temperature varies depending on driving style and highway/street driving. It changes with the oil cooler thermostat that is in front of the oil filter housing. What you are experiencing is normal for cars that have a thermostat on the oil cooler housing. It changes to maximize performance/fuel economy. |

I’m still confused after reading the letter. My brothers car still has the original water pump... so what’s the deal he has to wait till it blows up to get it replaced? Or bmw hasn’t gotten that far yet ? It seems like the letter is only for people who had it fail already?

You could appeal to BMW corporate customer service IF they were reimbursing but definitely try to contact the lawyers handling the class action. Make sure your repair is well documented with parts receipts and it would bolster the case if you had a record of error codes.

I just sent in my information with the attached invoice. The only issue I might have is that they want part numbers that I couldn't provide. The work was done by a independent shop that doesn't keep track of the numbers. Since the numbers should only be required if the work was done by a BMW dealer so that BMW can extend the warranty, the part numbers should be of no consequence. I purchased my X3 from my daughter-in-law last November. It is a 2013 M 35i and had only 29,000 miles on it (cream puff). I could never tell them about it because I got the "family deal" in the first place. Should never happen at that milage. I will post if I hear anything. Getting a check for $1283 for pump and thermostat would be ok!

BMW is not going to pay 1 cent more than they are required to under the settlement. There will be no "good guy" payout. If a case doesn't meet the exact criteria under law, there will be no money. It took a lawsuit for BMW to accept blame. They aren't going to open their wallets just to make people happy if they don't have to.

AS I read it BMW is not admitting liability but is offering a settlement that will be administered by the court through a third party. I am not an attorney but it was worth the time it took to submit my claim and roll the dice. Time will tell.

Getting a letter today from the appointed settlement administrator. The envelope is stamped "legal material inclosed". Could be a duplicate of my first letter or a notification that my submission has been received. Will keep you posted.
