Good luck Lotus! I really hope this is the fix! Reading this thread has made me nervous as I now have over 300 miles on my car but so far so good. Thanks for keeping us posted and well informed on all this too!

Awesome!! Glad to hear it's working out for you lotus! Sounds like your X3 wasn't a lemon after all, just slow customer service from BMW NA -- took them too long to order a new transfer case...

After four days of investigations, the service department cannot find out what cause the errors and claims that it happen because of the low battery level.... Also, they cannot find out the cause of the power window and have to order the motor from Germany to replace it.....

Lotus I went through this same push me pull you process when I had the dreaded GM6 transmission problem.

It took a lemon law attorney to get this resolved. The key to happiness is to document everything. Every phone call, every letter, every service, everything.

Where, when, how, and who.

They tried every trick in the book to blame it on me. It was my gas choice. Nope, have every receipt. It was my driving. Nope have my cert from your driving school. It was my car stereo I installed. Nope had a scope on and after I made change and nothing changed electrically, list went on and on.

After slapping down a binder 1 inch thick with paperwork and affadavits of other drivers running into the same problem "that no one else had the same problem or this wwas the first time they saw this".

Patience is a virtue when you are not being taken advantage of BMWNA tends to bite their nose to spite their face.

solution: A new X3.

I guess I don't need any more convincing that buying a first year modern BMW with complex electronics / parts is surely a risky proposition.

Lotus7 - not sure if you are BMWCCA member, but this would be a good story to send to Roundel.

Buying ANY car is risky.

I can’t think of a car model ever made that didn’t roll out a few with some sort of problem.

There have been remarkably few serious problems reported with the F25 when compared with other first model year cars, and so far just about every reported problem has been fixed.

Is it perfect? Nope, but nothing else out there is.

Does anyone know if this "Lemon Law" also exists in Canada or it is only US specific?
If not, are there any similar laws here or its just the "Wild Wild West Law"?

Canada does not have a lemon law, but they do have a process to address “lemons” that includes arbitration.

Several unlucky Canadian owners of the new Subaru Outback went through that process to get satisfaction.

I'd say that buying high performance / luxury cars are risky. While all cars can have problems, some makers like BMW and Audi just happen to have more (compared to the likes of Infiniti and Acura), and some models have more than others (7, X5, X3, more than 3 series). And this is just the short-term within warranty period - wait until 7 years / 80K later.

BMW has been getting a lot better in that respect.
For 2010 JD Power ranked BMW as the 3rd best in initial quality.

It's amazing how close the results are. Just a couple of problems per 100 makes a big difference in placement.

I think one problem with these surveys is that the seriousness of problems are not weighted.
A very minor easy to fix problem can count as much as a serious unfixable problem.
