Problem: Tailgate comfort access kick opening intermittent

Hey all, I've read a few posts about folks having problems with this but haven't really found a solution. Im have problems with getting my tailgate to open with the "kick' feature. It works 1 out of 10 times. I've tried a forward and rear kick at the center of the bumper (yes I've watched all of the BMW factory videos on what proper 'kick movement" should be). I've tried waving my foot around as well and again it only works one out of ten times. I've tried with the remote in my pocked, then moved it close to the tailgate and nada. I even put my phone into airplane mode thinking it could be interfeering. Has anyone experienced these problems? Could it be a weak remote battery or even a bad sensor?
