Stolen and recovered

Hi guys,

Appreciate this is a random one, but could use a sounding board.

A family member had their car stolen out of their driveway (in the NY tri-state), and the car was recovered a week later in Detroit.

When found, was carrying drugs and weapons (seriously), but the insurance company claims is that all it needs is an "interior detail."

Subsequent family obviously does not want the car back, but the insurance company is pushing hard for him to take it.

Anyone have any advice / experience with a similar situation?

Wow that's horrible. I obviously wouldn't want the car back either, you have no idea what went down with it while it was stolen.

Have you considered getting a lawyer involved?

Am thinking we may have no choice. Was my Dad's car.

Would just be creepy to have it back in some respects.

So wait has your car had any diminished value according to your car insurance provider? Is there anything on the history that says this incident occurred?

If you absolutely don't want to keep it, just sell it to vroom/carmax/carvana. You'll probably get nearly what you paid for it, maybe more in this market.

Otherwise get it professionally detailed. A thorough inspection at a dealer could also help give you some peace of mind.

Just throwing out ideas.

Thanks man. It's literally sitting in a lot in Detroit. Heard back today that it needs an "interior detail," but to your point the car was found with guns and drugs in it, so god knows what else happened in it.

I would think the value has been crushed, as presumably "stolen and recovered," will come up when the VIN is searched.

I'm going to suggest fighting it on the basis of a big mileage increase as well.

"Interior detail"?
Oy. Kind of like they need to completely re-assemble the interior after the initial search for and removal of the drugs. I'd get detailed pictures of the interior just in case you can provide that the work required is more than just an "interior detail". You might also insist that the interior be declared drug-free just in case other "residue" shows up later potentially causing further grief.

Perhaps it's state by state, but here in GA if a car is stolen and then recovered the car will forever have a salvage title.

Interesting. In other words, the value is shot. Seems awfully unfair that the insurance co can make you eat what could be a ~40% loss in value.

literally the same thing happened to me in Miami back in December. used a device to replicate my key and took it for a night out and dumped it nearby. No damage to the exterior but they made a huge mess out of the interior. Left loaded mags and stuff in the car.

I did a police report just to keep my bases covered in case the car was used for a crime / any red light issues. Insurance wasn't going to do shit so I just paid to have the car completely detailed. Thankful they didn't try to refuel since I was running the E85 tune haha. (car ended up being totaled by a dumbass two weeks later)

EDIT: Forgot to mention car fell of the tow truck after the accident. So yes Fate did not want me to have that car

This is definitely one conversation worth having with an attorney. Because the car has been used for transporting certain substances, the question is whether these substances can be detected later during a traffic stop (police dog).

X3M attorney here. OP private message me for a discussion. But i would not worry about being stopped/getting burnt for drugs previously in the car (that's not a thing) and I would suggest an alternative route for handling this with insurance which I don't care to post on here publicly

I am in NY. This is not (yet) legal advice

Waiting to see the car before doing anything. It's being flat bedded from Detroit.

The dealer I bought it from, thinks I can sell it before the title becomes dirty. We'll see. I know for certain I don't want it back.
