AlteBMW is quite correct. There is no demonstrable measure of damages so any legal action would be frivilous. Further, the moment the OP calls BMWNA and mentions a lawsuit, the phone call would end by policy of their General Counsel. Lastly, I again agree that BMWNA is the wrong defendant even if this cause of action had any grounds. BMWNA was not a party with any possible liability for any allegation of replacing the fuel cap improperly or surreptitiously. If the allegation is true, the independent entity dealer is the one who would have performed these actions. FYI, BMW did not make the gas cap. Their Tier I supplier made the gas cap. Taken together, OP, I suggest you do not follow any of the advice to pursue a legal action against BMWNA as a useless waste of your time, money, and emotions.

How about this...visit your dealer and simply ask to peek behind the fuel filler flaps for some new X3s in stock. When you see the caps all are the same as yours, it may provide you a sense of comfort that your vehicle is properly equipped. If they are not the same, ask the Service Manager to explain. Meanwhile, have you had a chance to review the Repair Order? Any part replacements would have to have been documented on that paperwork, otherwise the dealer would be giving away free parts.

If it's not on the RO, then it may remain a mystery. But at least the OP now knows that someone else, also in a pre-LCI had a cap gasket that wasn't blue.

made me go check my 2019 cap.
I am the only one who fills the tank (bought in 2018 so 5 years) and NEVER saw a blue gasket.........until now that I just checked.....

Mine is also blue, and the one on the loaner i'm currently driving is also blue. This is the OEM stock part. Its a non-issue

I have the same exact car, a 21 xDrive 30i. My gas cap is the same as your current one, with the blue gasket and same exact part number. I only recently purchased mine as a CPO, so I cannot say if it is the original cap or not. But at least it shows that it is a proper cap for this car, so hopefully that helps put your mind at ease.

I don't fault you for being a bit weirded out by this. I would be too. But now knowing it is fine and given that your initial questions didn't yield any info about a possible swap, I wouldn't bother pursuing it any further.

If it makes you uncomfortable that they might have done some undocumented work, then I would say choose another shop next time. To me, it doesn't sound like anything intentionally shady was done, so I would probably go back in the future if you have otherwise been happy with the service.

Just to bring this back up :-D I looked at my fuel cap when I was filling up yesterday. I have a 2022 LCI M40i and my ring thing on the cap was black :-D

The concern is if there is some silent recall on this. I have a black one and do get some strange gasoline fumes from time to time
