The fact the pedestrian was jaywalking matters, but it's unimportant next to these other things. Especially #2 and #3.
Do you seriously expect to not go to jail if you hit a pedestrian while street racing because they're jaywalking? That is one heck of an affirmative defense.

People do dumb shit sometimes....that driver is a dumb ass for racing on a congested city street. Most stop lights have cameras these days, or at least the major intersections.
The person that was hit is also a dumb ass, what kind of tard jaywalks into traffic at night, then stops in the middle of the road?
...but as a driver you are always supposed to be aware and the majority of the responsibility is with the driver.
He's one lucky SOB if he survived this.
