I am the LAST person who would leap to this conclusion, as so many people spout "a bug landed on my car and BMW should give me a new one", but assuming that everything you listed above is accurate and you are not omitting any pertinent information that would change the context.... I would recommend you get yourself a lawyer.
I strongly doubt that your X3 left Spartanburg in the condition you described, ergo it happened in transit or at the dealer before you got to it. These things do happen. Cars fall off of delivery trucks... really. Shame on your dealer for ever offering you this vehicle in the first place, but they are criminal if they had anything to do with the damage and attempt to hide it. Let the dealer, the carrier, and BMW NA work out who is at fault - you should be given proper satisfaction. At this point (actually on day one) you need to have a lawyer to do the speaking for you. Just my non-legally trained opinion, and based only on what I've gleened from this thread. I hope things work out, and as quickly as possible for you.

What is good to hear is that in every case there has been a major problem on this board and others with the X3, BMW has replaced the vehicle when it can not be fixed. Did they do so willingly, or did you have to do major battle with them?

I rejected the first X3 after inspection. The paint job was so bad that I couldn't accept it. I saw a hair or a dot that was underneath the clear coat. It also had a few scratches on the rear bumper and trunk as well. Fortunately, I found out about these when I was still in the dealership. So the dealer re-ordered another X3 for me. To my knowledge, the dealer DID NOT send that car back.
The second X3 (my current one) was much better in terms of the paint job. But I didn't realize I had a color mismatch until I was detailing my car a week later. I ordered a jet black X and the left rear mirror was sapphire black. I demanded the dealer order the Jet Black rear mirror cover directly from North Caroline. So... I would really like to hear how this went for you. I just got my x3 30 days ago and its going in to the RSM is coming out to look at it tomorrow. It's been aligned twice, I had the "crown of the road" speech and the "run flat" speech. After the shop foreman drove it, he acknowledged the issue. We'll see, i'm seriously doubting after reading your post and others that this issue can be fixed. How was the process to get your car bought back?
