Valvetronic help please

Hey all. Need some help here. I have a 2009 x3 with the n52b30 engine. Shaft on the valvetronic motor broke during the cold snap resulting in a crank but no start situation. I replaced the motor, valve cover gasket, eccentric sensor seal, spark plugs, coils and battery. Relearned valvetronic limits. Got it running again but when i first start it in the morning the MIL light comes on and it goes into limp mode, throwing code P1030 (valvetronic motor sluggish). Start it a few times and its golden for the rest of the day where it will start and run without a hiccup. Next morning rinse and repeat. Any recommendations? Im thinking eccentric shaft sensor but dont want to throw $650 at it and it not be the issue.
