New owner of 2011 BMW X3

We purchased this pre-owned in November of 2018. Experiencing something very concerning. While pressing on the acceleration at random it will feel like resistance is applied. As if the brakes are being applied. I continue to press the acceleration and it will not accel. Then the car begins to shake. The remedy seems to be pulling over and putting the car in park or turning it off. I have taken it back to the dealership. no codes, not dummy lights, we are all stumped. and I am afraid we have purchased a lemon. Anyone else experience this?

What engine? N52 or N55?

I'm local. I'd recommend taking the car to Paddock Imports in Denver.
