Rear BMW Emblem of X3

Another issue we have after receiving our car back from the panel beaters is the BMW emblem on the tailgate appears 'crooked'.

The bodyshop from BMW says that is hard to be as there are 2 gromets at the back that allign with the holes, but what happened was this we suspect:

We know the panel beaters did not order a new BMW emblem for the rear, I can tell as it still fogs up with markings from the paint protection that I applied to it.

They tried to remove the emblem, stuffed it up, broke the gromets and simply glued the damn thing back on.

Am i able to test this by removing the rear emblem? If it isn't glued it, should it come off easily? There are plenty of space between the emblem and the paint when we first got it, not there is literally no space to fit a credit card in between, thus explaining the fact they glued it back on to save $100.
