Someone else suggested "leaning back" when you do the kick, because there's another sensor that prevents it from opening if you're too close. So far it's worked 100% of the time now.
BMW should have the car beep 3 short times or something to alert you that it got the kick-to-open request, but you're too close. It would go a long way to help people understand what they're doing wrong. I know I spent a lot of time trying to kick at different places around the bumper when that had nothing to do with the issue.
