I would have the dealer inspect the guide and replace if necessary. Apply for reimbursement after the lawsuit is finalized. Now you are playing Russian roulette hoping that the motor will not blow as you drive and if it does, hoping it will be covered. $1200 is a lot, but less than how much you'll lose if the motor goes.
