I don't know a whole lot about how these types of cases work, but I'm hoping they get to some kind of a discovery phase soon. I want to see the statistics that BMW has been keeping related to the types of failures they have seen, under what conditions and the total number of vehicles that have had a repair, any kind of repair, caused by the defective timing chain guides. They should be able to obtain this information through discovery.
