Yes! I have done this on our X3 35i and our 2011 335i without any problems. The sound is a more distinct grumble on start up and with light to moderate throttle acceleration. It just gives a little more beefiness to the sound, but it's not anything amazing like an aftermarket exhaust system.
It is a little more noticible on the the 335i and have driven it this way for 15,000 miles.
Honestly, it will throw a shadow code - but no SES lights or CEL's in the dash to worry about. The dealer will not hassle you about this.
And if they do decide to be tight asses, a mysteriously disconnected or "loose" cable would be easier to explain than a broken off golf tee or too small of a bearing lost in your vaccum line
