Many "expert" reviews have noted this as well. I'm guessing that BMW had to keep the rear seat as low as possible in order to keep the weight lower (less top-heavy) which keeps the handling in check. If the rear seats are theater style it creates a rear end that has a higher center of gravity than the front.

THe only people I'd have on long trips are my kids so not as much of an issue for me, but I see your point
