At the end of the day, they could blame it on a whole host of aftermarket modifications you made. Increased boost from tune could cause premature turbo failure, etc.
I don't think you're going to win this one. It's best to keep the powertrain stock until the warranty period is over. Or just buy a faster car to begin with.
