A filter (expecially BMS) doesn't just fail suddenly after 45K miles without issues... They're going to have a hard time proving the filter caused the issue unless there are pieces missing from the filter, or an obvious hole in the filter media itself. Barring those two things I fail to see how the filter would contribute to fin damage.
