It is set to be active by default and is overridden but the switch- the EPA tests by DEFAULT so BMW would make this on by default to get the best MPG, no sense in offering a technology that costs about $500 per unit with no EPA acknowledgment and yes it does work in the EPA test.
I probably spoke to soon. We don't know if it will default to Off, or On with the X3. On my M3, it is default to Off, but on the F10 I remember now it defaults to On.
Last I saw, the EPA doesn't take Stop/Start into account for CAFE ratings.
